Outrage against the many evil things perpetrated by the Labour/Alliance communist regime is finally, unmistakably beginning to ferment. Among the signs: independent contractors are waking up to the implications for them of the Employment Relations Bill; policy-holders wanting to dip into their superannuation savings are bridling at the surtax now to be imposed on them for doing so, in breach of Labour's election commitments; smokers likewise are indignant at the savage increase in the tobacco tax; & those with a modicum of appreciation of what it was their forefathers fought against Hitler for are alarmed at the banning of access to the Havana House internet site. All week I have been urging you to go the site - havanahouse.co.nz - be duly deflected to the Ministry of Health, & tell the nico-nazis what you think of them. One listener who did so actually received a reply. Here's what it said:


Thank you for your email concerning Havana House. The Ministry of Health has a statutory obligation to administer legislation for which it is responsible and to investigate clear breaches of this legislation. Failure to carry out this duty can result in judicial review. Section 22 of the Smoke-free Environments Act prohibits the publication of any tobacco product advertisement in New Zealand. Tobacco product advertisement is defined as:

"any words, whether written, printed, or spoken, including on film, video recording, or other medium, broadcast or telecast, and any pictorial representation, design, or device, used to encourage the use or notify the availability or promote the sale of any tobacco product or to promote smoking behaviour."

The Ministry of Health has received legal advice which concludes that, where a website contains a tobacco product advertisement as defined by the Smoke-free Environments Act 1990 (the Act), where that website is accessed by a New Zealand Internet user and the information on the site is sent electronically to user's computer, at the point the advertisement has been published in New Zealand for the purposes of section 22 of the Act.

When administering legislation, the Ministry balances freedom of expression and speech issues alongside the need to both implement the law and the need to prevent the promotion of tobacco products which, when used as the manufacturer intends, kill half their consumers an average of 14 years early.

Media comments on issues similar to this have centred on the freedoms inherent in the Bill of Rights Act 1990. The Ministry notes that section 4 of the Bill of Rights contemplates that there will, from time to time, be legislation which is not consistent with the Bill of Rights.

When the Smoke-free Environments Bill was considered by Parliament in 1989/1990, the significant health effects of smoking and the need to discourage its promotion were considered to override the right to advertise and promote these deadly products. A similar stance is taken in relation to other issues such as the display of child pornography or the promotion of violent activity or racial hate material. In these cases Bill of Rights issues are considered secondary to protecting the population from harm.

We trust this clarifies the situation.


To which I say, the situation was already clear, actually. Hitler lost the war, but he won the battle. Our latter-day bossyboot governesses will ride roughshod over our precious freedom of speech whenever they choose in the name of the greater good, of which they are self-appointed arbiters. The tragedy is, YOU endorsed their pretensions to that status. But as I said at the outset, some of you are now beginning to wake up. When enough sheeple have reclaimed their humanity, perhaps there will be a storming of Helengrad comparable to the allied storming of Berlin in 1945. Let us hope that in that event the vile excrescences currently exercising their dictatorship from that city will do the decent thing & remove their odious presence from our midst, as Hitler did - voluntarily & permanently.
